Terms & Conditions
DEPOSITS: A non-refundable 50% deposit is required to initiate orders. DUE TO THE CUSTOM, HAND MADE NATURE OF OUR PRODUCTS, ALL SALES ARE FINAL AND WE OFFER NO REFUNDS OR EXCHANGES.
BALANCES DUE: As an order approaches completion, we will bill the client for the balance due. All balances are due prior to shipping or picks up by the client. If payment in full has not been received within ninety (90) days of the final invoice, Thomas Hayes Studio reserves the right to retain the merchandise and to declare a forfeiture of the deposit as liquidation damages. Thomas Hayes Studio retains title to all merchandise until it is fully paid for by the client.
LEAD TIMES: Our standard lead time is eighteen (18) weeks for all items, though this is subject to change. The lead time starts upon the date that the following are received:
a. 50% deposit
b. Completed order form acknowledging all order details and specifications.
c. Agreement of sales terms
COM/COL must be received within 4 weeks of the lead time’s start date to ensure we can complete withing the standard lead time. Please remember that lead times, quoted completion dates, and quoted delivery dates are estimates only and may be revised at the Studio’s discretion. Due to the handcrafting of our product, Thomas Hayes Studio will not be held responsible for late deliveries.
RUSH ORDERS: Rush orders may be placed, subject to availability, for an additional fee equal to 25% of the order total to reduce the current lead time in half.
CUSTOM ORDERS: Custom sizes and details are available on most Thomas Hayes Studio pieces. Please confirm with Thomas Hayes Studio if the requested customization is available. Depending on the requested customization, lead times may need to be increased from the standard.
FINISHES/SAMPLES: Although we strive to consistently match our finish samples to the final product, all Thomas Hayes Studio items are finished individually by hand and therefore, slight variations in color, tone, and texture will occur. No guarantee can be made of an exact match. Samples of our finishes are available for purchase on our website. In the case of natural woods, with and without added stains, there may be some variation in color, grain, and figuration in the natural material between the sample provided and the finished item.
CLIENT’S OWN MATERIAL/LEATHER (COM/COL): Thomas Hayes Studio does not supply any upholstery material and it is to be supplied by the client. All COM/COL is to be shipped to 6162 Santa Monica Blvd Los Angeles, CA 90038. All COM/COL must be received within 4 weeks of the lead time’s start date to ensure we can complete withing the standard lead time. Packing slips of the shipped material must clearly indicate the client’s name and order number. Received material with no indication of who the material belongs to will delay the production of the order. Once received, Thomas Hayes Studio will photograph the COM/COL and email the client for approval. The approval of these photographs supersedes all other correspondences between Thomas Hayes Studio and the client regarding the COM/COL. Including but not limited to samples and clippings shipped to Thomas Hayes Studio.
SOLID SLAB WOOD PIECES: Due to the distinctive nature and variability of the natural material, any item with solid slab wood may have some knots, filled knots, crotches, pitting, and/or other slightly rustic elements, and no two pieces are exactly the same. Partial live edge wood slabs are subject to availability and can be specified or not depending on the item. All wood is hand-selected per the specifications attached to this invoice. Pictures on our website are representative of the products you will receive. There are properties that are unique to solid slab wood, and as part of the natural drying process, cracks or checks may also occur and do not affect the structural integrity of an item. We use primarily old-growth wood that has been in its natural environment and exposed to the elements over time; it, therefore, has the variable rustic characteristics and differences in graining, color, and tone described above, which is what we love about the woods we use.
DIMENSIONS: Dimensions are given to the nearest half-inch. Because all items are made and assembled by hand, measurements may vary slightly from those stated or specified. Dimensions are provided as general reference only.
SHIPPING: Thomas Hayes Studio does not offer shipping, crating, and/or packaging services. Clients are responsible for their own shipping arrangements and will need to pay any charges related to shipping directly to the appropriate vendor.
HANDLING: All orders are subject to a handling fee of 3.7%. This is a standard charge for the care, handling, and other fulfillment related costs. Thomas Hayes Studio reserves the right to relocate finished goods to a third-party for storage if the client fails to retrieve on the day of completion. The client is responsible for all fees charged by the third-party storage company including but not limited to storage costs and release fees.
DAMAGE IN TRANSIT: Title to the merchandise passes to the purchaser upon pick up by the freight carrier or shipper. Thomas Hayes Studio is not responsible for damages, whether concealed or visible, incurred in transit. Thomas Hayes Studio is not responsible for damage after the transportation company has accepted the merchandise in good order. Claims for damage should be filed immediately, in writing, with the delivering carrier. All claims for loss or damage to merchandise while in transit must be made by the consignee/receiver and settled with the carrier.
WARRANTY: Thomas Hayes Studio warrants all products against defects in materials and workmanship for one year from the date of receipt by a client or receiving warehouse, whichever is sooner. This warranty does not apply to breakage resulting from misuse, accidents, abuse, neglect, mishandling, or wear resulting from normal use. Defective products will be replaced within the normal production time period required to reorder and manufacture the same product. Thomas Hayes Studio does not warrant finishes against fading and oxidation.
CHANGE ORDERS: All change orders must be submitted to Thomas Hayes Studio in writing. Written acknowledgment from Thomas Hayes Studio is required before a change order can be considered to be received. Depending on the requested change lead times may need to be extended.
RESERVATION OF RIGHTS: Thomas Hayes Studio owns any and all copyrights or other intellectual property rights associated with any custom home furnishings produced by Thomas Hayes Studio for its clients. Thomas Hayes Studio reserves the right to recreate any custom home furnishing either for display or for sale or lease to third parties, which recreation may be exact replicas or variations of the custom piece commissioned by any such client.
